Unless a separate written agreement states otherwise, unsolicited ideas, proposals, materials, or suggestions are not confidential. Do not submit trade secrets, privileged information, sensitive health information, complete financial-account information, or other highly confidential material through a general website form.

08

Donations and Contributions

Contributions made through or in connection with the website are voluntary. Donations may be processed by an independent third-party payment provider and may also be subject to that provider's terms, privacy policy, processing rules, and security practices.

Important Tax-Status Notice

The Leah Michelle Farquharson Foundation, Inc. is currently seeking recognition as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. While that application is pending, donors do not have advance assurance that contributions are tax-deductible. Donors should consult their own tax adviser regarding their individual circumstances.

The Foundation may use unrestricted contributions for lawful, mission-aligned purposes, including organizational development, planning, outreach, communications, administration, technology, supplies, future initiatives, and approved activities.

A donor should contact the Foundation before making a restricted, designated, in-kind, sponsorship, or conditional contribution. The Foundation may decline, return, redirect, or seek clarification regarding a contribution when necessary or appropriate.

Refund requests are reviewed individually. Unless required by law or payment-processor rules, completed donations are generally final once accepted and processed.

09

Volunteer and Partnership Inquiries

Submitting a volunteer, partnership, sponsorship, or collaboration inquiry does not create an employment relationship, agency relationship, contract, fiduciary duty, partnership, joint venture, or guarantee of selection.

Opportunities may depend on current needs, available supervision, background requirements, scheduling, training, organizational capacity, safety considerations, funding, and other factors.

Additional applications, releases, policies, screenings, agreements, orientation, or approval may be required before participation.

10

Events, Programs, and Activities

Event dates, locations, eligibility requirements, capacity, participation rules, featured speakers, partners, and planned activities may change. Registration does not necessarily guarantee admission or participation.

Separate event terms, waivers, releases, photography notices, codes of conduct, refund policies, safety requirements, or parental permissions may apply to a particular activity.

11

Third-Party Links and Services

The website may link to or display content from third-party websites, payment platforms, social networks, maps, videos, forms, registration tools, vendors, partners, or other services.

Links are provided for convenience and do not necessarily constitute endorsement, sponsorship, control, or responsibility. The Foundation is not responsible for third-party content, availability, accuracy, privacy practices, security, products, services, or transactions.

You should review the terms and privacy policies of third-party services before using them or providing information.

12

No Professional Advice

Website content is provided for general information only.

Nothing on this website constitutes legal, medical, mental-health, tax, accounting, financial, investment, insurance, counseling, educational, or other professional advice.

You should consult an appropriately qualified professional before making decisions based on information that may affect your legal, medical, financial, tax, or personal circumstances.

In an emergency, contact the appropriate emergency service or qualified professional rather than relying on this website.

13

Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory.

The Foundation does not warrant that the website will be uninterrupted, error-free, secure, accurate, complete, current, suitable for a particular purpose, or free of harmful components.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to every visitor.

14

Limitation of Liability

To the fullest extent permitted by applicable law, the Foundation and its directors, officers, representatives, volunteers, employees, contractors, partners, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of, inability to use, or reliance on this website or linked third-party services.

This limitation applies regardless of the legal theory asserted and even if the possibility of such damages was known or should have been known.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

15

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Foundation and its directors, officers, representatives, volunteers, employees, contractors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person's rights.

16

Suspension or Termination of Access

The Foundation may restrict, suspend, or terminate access to any part of the website when it reasonably believes a visitor has violated these Terms, threatened website security, interfered with operations, or engaged in unlawful or harmful conduct.

17

Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where federal law or another mandatory law applies.

Subject to applicable law, disputes relating to the website or these Terms will be brought in a court of competent jurisdiction located in Georgia. Nothing in this section prevents the parties from attempting to resolve a concern informally before litigation.

18

Severability and Waiver

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

A failure by the Foundation to enforce a provision does not waive the right to enforce that provision or any other provision later.

19

Entire Agreement and Updates

These Terms, together with the Privacy Policy and any additional terms presented for a specific form, event, donation, activity, or service, constitute the agreement concerning use of this website.

The Foundation may update these Terms from time to time. Revised Terms will be posted on this page with a new “Last Updated” date. Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.

Faith. Courage. Love.
